-----Question-----
according to the A.M.A. GUIDE that doctors use for permanent disability ratings,my doctor told me ,my ratingshould be 10% before surgery . after he performed the surgery he said there was nerve damage and he had to remove and i will no longer have feeling in 2 of my toes.it was sucessful as for as for pain he said since there will not be any nerves butas for as the damage its been done from the injury.in other words he just gave me relief from pian and according to A.M.A. PAIN IS NOT RATED. But my question is shouldn't my rating increase since the damage was more than what he thought pre surgery ?he removed the damage nerves.dead spot on top of foot and 2 toes. thank you

Anthony,

Disability is based on the final outcome.  Since you have had pain relief, you are no longer disabled.  The numbness between the toes has no disability associated with it because it does not sigificantly affect your walking.  Also, often you will reain the senasation.

You had a problem that has been treated successfully and that was the idea of the surgery.  The goal is for you to no longer be disabled and return to normal function.

To have a high disability level realting to the foot you would have to lose total function or have suffered an amputation.

Good Luck

Answer
Anthony,

It sounds like you had quit an injury.  If you are left with pain from the injury that should certainly be considered.  That is assuming that you don't get better with further treatment.  Your disability determination will consider your ability to do your current type of work.

I hope all goes well and your condition improves.

Sincerely,
